Notwithstanding the law of December 31, 1903, the successful bidder acknowledges and agrees that any items not picked up by the bidder within three months will be considered abandoned and may be sold following the filing ofa petition to the court, and that Drouot will not be required to wait one year to proceed with their auction sale in accordance with the law of December 31, 1903. Consequently, it is hereby reiterated that items not collected within three months may be put up for sale again to cover storage costs. By way of a contractual extension of the law of December 31, 1903—which permits only the sale of abandoned items but does not grant the custodian the right to seek a court order to destroy them—the successful bidder expressly acknowledges that items of low market value (i.e., items with a purchase price by the successful bidder of less than 50 euros) that have not been collected by the successful bidder within six months shall be considered definitively abandoned by the successful bidder. Ownership of these items will then pass to TSE, which may destroy them after sending a registered letter with return receipt (LRAR) that remains unanswered for one month, without having to seek a court order as provided for in Article 2 of the Law of December 31, 1903, concerning the sale of abandoned property. In any event, in the event of destruction, the successful bidder may under no circumstances claim damages exceeding the purchase price paid by the successful bidder for the destroyed item.
